Mr. Miles is a seasoned complex commercial litigator, with deep experience in intellectual property, entertainment, and art law. He has accumulated extensive complex civil litigation experience from pre-lawsuit to verdict, including development of case strategy, drafting and arguing dispositive motions, taking and defending depositions, and leading mediations and arbitrations. He and his firm are at the forefront of developments in right of publicity and defamation cases. Mr. Miles is actively involved in some of the most high-profile defamation and right of publicity cases arising from social media and internet speech. Mr. Miles also enjoys a thriving transactional practice involving drafting and negotiating contracts for creatives and artists. He has regularly hosted CLEs and talks on art law and legal issues relating to art and art collecting. Mr. Miles serves on the Executive Committee of the Entertainment Law and Intellectual Property Section of the Los Angeles County Bar Association.

Representative Matters

• Successfully first chaired JAMS arbitration relating to the rights to a legendary Hollywood composer's multimillion dollar music catalog.
• Presented oral argument on, and subsequently defeated, motion to dismiss before District Judge Edward M. Chen in the Northern District of California in Visual Artist's Rights Act litigation on behalf of six artists suing a property owner for painting over a beloved mural at a famed San Francisco gay bar during Pride Month.
• Represented Fortune 200 consumer products company embroiled in talcum powder litigation in numerous jurisdictions across the country in state and federal court. Obtained Frye and Daubert exclusion orders in multiple courts throughout the country against key liability experts proffered by the plaintiffs. Secured some of the first summary judgment victories for a cosmetic talcum powder manufacturer. Participated on trial teams that obtained jury defense verdicts in multiple cases against the same talcum powder manufacturer.
• Investigated and brought derivative complaint in Delaware Court of Chancery against Founder/CEO Jack Dorsey of Twitter for negligent failure to maintain users' private data, and breaches of fiduciary duty relating to Dorsey's dual role as CEO of Twitter and Square.
• Drafted the complaint and managed all aspects of discovery and early motion practice for Morgan Art Foundation v. McKenzie, a contentious dispute over artist's Robert Indiana's oeuvre and legacy.
• Successfully represented Oakland Bulk and Oversized Terminal (“OBOT”) in week-long bench trial before Judge Vince Chhabria in the contentious, high-profile OBOT v. City of Oakland litigation over the Oakland Coal Terminal in the Northern District of California.
• Involved in all aspects of numerous Qualcomm v. Apple patent infringement cases brought on behalf of Qualcomm across multiple jurisdictions.
• Represented Alphabet's Waymo in trade secret misappropriation case involving autonomous vehicle technology, in which Waymo obtained a preliminary injunction and other provisional relief prior to trial.  The case settled on the fourth day of trial pursuant to a confidential settlement agreement.
• Defended the County of Los Angeles and the Los Angeles County Sheriff's Department in several lawsuits relating to claims of retaliation, discrimination, and hostile work environment caused by deputy “subgroups,” including the Banditos.
• Successfully resolved copyright infringement and DMCA § 1202 claims on behalf of graffiti artist Hektad against Home Goods, Inc., in which Home Goods widely distributed and sold a puzzle displaying Hektad's “Love is Love” mural without authorization.
• Successfully resolved trademark infringement and unfair competition claims on behalf of graffiti artist Futura based on allegations that North Face coopted Futura's signature motif for a line of outerwear.
• Successfully resolved a class action on behalf of shareholders who acquired common stock of Sterling Bancorp in Oklahoma Police Pension and Retirement System v. Sterling Bancorp, et al., No. 5:20-cv-10490-JEL (E.D. Mich.), based on allegations that defendants engaged in widespread fraud to conceal from investors questionable practices in the bank's residential lending practice.
