Frank Trechsel is a senior associate at Johnson & Johnson LLP. Mr. Trechsel's is a creative litigator whose practice focuses on entertainment, art, and copyright litigation. Mr. Trechsel has litigated copyright infringement claims for the illegal use of photographs, fashion designs, a music, and drafting motions related to and involving safe-harbor protection under the Digital Millennium Copyright Act, fair use, statute of limitations, and the server test.

Mr. Trechsel has extensive entertainment and music litigation experience including but not limited to numerous cases for musician, management, and record label clients relating to recording and management contracts, Talent Agency Act litigation, and defamation cases.

Mr. Trechsel graduated cum laude from Tulane University Law School and obtained his undergraduate degree with distinction from Indiana University. When not zealously representing his clients, he enjoys live music, festivals, games, and the beach. He has also worked for and volunteered with multiple production companies, music venues, and music festivals and is intimately familiar with the live music and event industry.

  • Represented Jamaican dance-hall originators Steely and Clevie in one of the most ambitious music copyright cases of this decade against over one hundred defendants for the use of their dance-hall his "Fish Market" in over 1,000 reggaeton, Latin, and pop hits.
  • Drafted Plaintiff's appellate briefing in Ninth Circuit appeal McGucken v. Valnet, Inc. Case No. 24-511 challenging the ninth Circuit's "server test" rule.
  • Drafted and won Ninth Circuit appellate case McGucken v. Pub Ocean, 43 F 4th 1149 (2022) setting precedent on the issue of fair use in the Ninth Circuit.
  • Worked on the appellate case for the highly publicized copyright lawsuit over the song Blurred Lines on behalf of Marvin Gaye's Estate.
